TERMS AND CONDITIONS / STUDENT ENROLMENT AGREEMENT

Certified Hypnotherapist Practitioner Training
This is a legally binding agreement between you ("Student", "you") and Maddison Everist, Bloomin Within ("Maddison Everist, Bloomin Within", "we", "us", "our" Maddison Everist, Bloomin Within 18 851 486 713) governing your enrolment in the Certified Hypnotherapist Practitioner Training (the "Program"). By submitting payment, ticking the acceptance box at checkout, or otherwise enrolling in the Program, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
- Definitions
1.1 "Program" means the Certified Hypnotherapist Practitioner Training, a non-clinical scope certification delivered by Maddison Everist, Bloomin Within, comprising live training, a practical intensive, self-paced learning, supervised practice, and assessment, as described on the Program sales page and enrolment materials current at the time of your enrolment.
1.2 "Cohort" means the specific intake of the Program you enrol into, identified by its commencement date and also the associated immersive dates selected upon checkout and classified via the cohort enrolled into at time of checkout.
1.3 "Certification" or "Certificate" means the certificate of completion issued by Maddison Everist, Bloomin Within to a Student who has satisfied all completion requirements set out in Clause 8.
1.4 "Fees" means the total tuition fee payable for the Program, whether paid in full or via a Payment Plan.
1.5 "Payment Plan" means an instalment payment arrangement offered by Maddison Everist, Bloomin Within as an alternative to payment in full.
1.6 "Practicum" means the supervised and peer practice hours required as part of the Program, as described in Clause 11.
1.7 "Materials" means all course content, curriculum, recordings, scripts, templates, workbooks and resources provided as part of the Program.
1.8 "ACL" means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- About This Agreement
2.1 This Agreement applies to your enrolment in the Program from the date of your purchase and continues until you have either completed the Program and been issued your Certification, or your enrolment is otherwise terminated in accordance with these Terms.
2.2 Maddison Everist, Bloomin Within may update these Terms from time to time in accordance with Clause 21. The version of these Terms in force at the time of any dispute or event will govern that dispute or event, except where a later version confers additional rights on you.
2.3 If any provision of this Agreement is inconsistent with a right you hold under the ACL or other applicable law that cannot be excluded, restricted or modified, that provision applies to the extent of the inconsistency and this Agreement is otherwise unaffected.
- Program Overview and Scope of Practice
3.1 The Program is a non-clinical scope certification. It trains Students to facilitate hypnotic experiences that support personal development, behavioural change, confidence, relaxation, and subconscious-focused facilitation within a complementary, non-clinical framework.
3.2 The Program does not qualify graduates to diagnose, treat, or manage clinical mental health conditions, including but not limited to trauma-related disorders, PTSD, major depressive disorder, other psychiatric conditions, or medical conditions. Students and graduates must operate within this non-clinical scope of practice at all times and refer clients to appropriately qualified professionals where a matter falls outside this scope.
3.3 Maddison Everist, Bloomin Within makes no representation that completion of the Program qualifies a Student to practise under any particular state, territory, national or international regulatory scheme, or to obtain professional indemnity insurance, membership of a professional association, or accreditation with any particular body. It is the Student's responsibility to make their own enquiries regarding regulatory, insurance and accreditation requirements applicable to their practice and jurisdiction.
3.4 No Guarantee of Outcomes. Maddison Everist, Bloomin Within does not guarantee any specific personal, professional, financial or business outcome as a result of completing the Program, including but not limited to client numbers, income, or business success. Individual results depend on factors outside Maddison Everist, Bloomin Within's control, including the Student's own effort, engagement, and circumstances.
- Eligibility and Enrolment
4.1 The Program is intended for adults aged 18 years or older. By enrolling, you confirm that you meet this requirement.
4.2 Enrolment is confirmed upon receipt of your deposit, first instalment, or payment in full, as applicable, and your acceptance of these Terms.
4.3 Maddison Everist, Bloomin Within reserves the right, at its sole discretion, to decline or cancel an enrolment prior to Program commencement, including where cohort capacity has been reached, where eligibility requirements are not met, or where Maddison Everist, Bloomin Within reasonably believes the Program is not appropriate for the applicant. In such cases, any Fees paid will be refunded in full.
4.4 You are responsible for ensuring the accuracy of the information you provide at enrolment, including contact details, health information relevant to your participation (see Clause 12), and payment details.
- Fees and Payment
5.1 The Fees for the Program are as set out on the sales page and/or enrolment invoice current at the time of your enrolment.
5.2 Payment in Full. Students who pay the full Fee at the time of enrolment receive [pay-in-full pricing / any applicable discount, per current offer].
5.3 Payment Plans. Where offered, Payment Plans allow Fees to be paid via instalments over an agreed period. By selecting a Payment Plan, you authorise Maddison Everist, Bloomin Within (or its payment processor) to charge your nominated payment method automatically on each instalment due date until the Fees are paid in full.
5.4 Failed or Late Payments. If an instalment payment fails or is not received by its due date: (a) Maddison Everist, Bloomin Within will attempt to notify you and will re-attempt the charge; (b) a grace period of [7] days applies before further action is taken; (c) if payment is not received within the grace period, Maddison Everist, Bloomin Within reserves the right to suspend your access to Program Materials, live sessions, and community platforms until the outstanding amount (plus any reasonable administration fee of up to [$50 AUD] per failed payment upon Maddison Everist, Bloomin Within discretion) is paid; (d) continued non-payment beyond [30] days may result in termination of your enrolment in accordance with Clause 20, without refund of amounts already paid.
5.5 All Fees are quoted in Australian Dollars (AUD) and are inclusive of GST where applicable, unless otherwise stated.
5.6 Fees for future cohorts may differ from the Fees you paid. Your enrolment secures your place and pricing for your specific Cohort only.
5.7 Fees do not include costs you may separately incur in connection with the Program, including but not limited to books or other materials (except where expressly stated as included), professional indemnity insurance, or membership/accreditation fees with third-party bodies.
- Cooling-Off Period
6.1 Voluntary Cooling-Off Period. Maddison Everist, Bloomin Within offers a voluntary 7-calendar-day cooling-off period from the date of enrolment (“Cooling-Off Period”).
6.2 Limitations of Cooling-Off Period. The Cooling-Off Period will end immediately if: (a) the Program commences within the 7-day period following enrolment; (b) you access more than 10% of the Program Materials; (c) you attend any live training session, intensive workshop, or practical component of the Program; or (d) you commence participation in any assessment, practice requirement, or cohort activity.
6.3 Exercising Your Right to Cancel. To exercise your right to cancel during the Cooling-Off Period, you must provide written notice to Maddison Everist, Bloomin Within at hello@bloominwithin.com.au within the applicable timeframe. Where the cancellation requirements under Clause 6.2 have not been triggered, Maddison Everist, Bloomin Within will provide a refund of fees paid, less any applicable non-refundable payment processing fees.
- Refund & Cancellation Policy
7.1 Before Cooling-Off Period Expires. Refunds during the Cooling-Off Period are governed by Clause 6.
7.2 After Cooling-Off Period but Before Program Commencement. If you cancel your enrolment after the Cooling-Off Period has expired but before the commencement date of your selected cohort, Maddison Everist, Bloomin Within may provide a refund at its discretion, less: (a) any payment processing fees incurred; (b) an administration fee of 10% of the total Program investment; and (c) any costs already incurred by Maddison Everist, Bloomin Within in preparing your enrolment, cohort placement, or access to Program resources.
7.3 Limited Cohort Capacity. By enrolling in the Program, you acknowledge that Maddison Everist, Bloomin Within operates intimate cohort-based certifications with limited places available. Your enrolment secures your place within the selected cohort and allows Maddison Everist, Bloomin Within to allocate resources, support, and preparation accordingly.
7.4 After Program Commencement. Once the Program has commenced, including from the date of your first live session or first access to Program Materials (whichever occurs first), fees are non-refundable except as outlined in Clause 7.5. This applies whether you have paid in full or selected a Payment Plan. A Payment Plan is a commitment to the full Program investment. Instalment payments remain due according to the agreed payment schedule regardless of your ongoing participation, completion, or attendance, except where Maddison Everist, Bloomin Within terminates your enrolment without cause.
7.5 Exceptional Circumstances. Maddison Everist, Bloomin Within may, at its sole discretion, consider exceptional circumstances such as serious illness, injury, or bereavement. Where appropriate documentation is provided, Maddison Everist, Bloomin Within may consider options including: (a) deferral into a future cohort; (b) credit towards another Maddison Everist, Bloomin Within offering; or (c) partial refund. Any decision made under this clause is at the sole discretion of Maddison Everist, Bloomin Within and does not create an ongoing entitlement.
7.6 No Refunds Due to Non-Participation. No refunds will be provided where a participant: (a) changes their mind after the Cooling-Off Period; (b) does not complete the Program; (c) does not attend required sessions; (d) does not complete assessment or practice requirements; (e) does not achieve their desired personal or professional outcomes.
7.7 Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.
- Certification Requirements
8.1 To be eligible to receive the Certification, a Student must: (a) attend or view (via recording) all 12 live training sessions, with a minimum live/timely-viewing attendance of [50%]; (b) attend the two x 3-day live online Practical Intensive in full, or make alternative arrangements approved in advance by Maddison Everist, Bloomin Within in the case of documented exceptional circumstances; (c) complete all self-paced learning modules and required reading; (d) complete a minimum of 50 hours of practice, including at least 2 recorded sessions submitted for assessment and 10 hours of formally supervised practice, in accordance with Clause 11; (e) pass all module knowledge assessments, the written assessment, and the practical competency assessment; and (f) have paid the Fees in full, in accordance with Clause 8.2.
8.2 Certification Contingent on Payment in Full. Where a Student has selected a Payment Plan, Maddison Everist, Bloomin Within will not issue the Certification, confirm practitioner recognition, or release completion documentation until all instalments have been paid in full, even where the Student has otherwise met the requirements of Clause 8.1(a)–(e) ahead of completing their Payment Plan. This policy is disclosed to Students prior to enrolment and forms part of the enrolment terms accepted at checkout.
8.3 Where a Student completes all requirements in Clause 8.1(a)–(e) before their Payment Plan is paid in full, Maddison Everist, Bloomin Within will confirm in writing that the Student has met all academic and practical requirements, and will issue the Certification promptly upon receipt of the final instalment.
8.4 Where a Student's Payment Plan extends beyond the standard six-month Program duration, the Student retains access to Program Materials and community support until their Payment Plan is complete and their Certification is issued, subject to Clause 5.4 (Failed or Late Payments).
8.5 Certification Contingent on Conduct and Ethical Standards. In addition to the academic, practical and payment requirements above, Maddison Everist, Bloomin Within reserves the right to withhold, suspend, decline to issue, or revoke and remove a Certification (including where already issued) at any time where a Student or graduate: (a) breaches the Student Code of Conduct (Clause 13) or any ethical standard reasonably expected of a practitioner in this field; (b) attends any live session, the Intensive, practicum, or any Program-related activity while intoxicated or otherwise impaired by alcohol or drugs; (c) engages in harassment, discrimination, bullying, or abusive conduct toward a fellow Student, teaching staff, practice partner, practice client, or any other person connected with the Program; (d) engages in inappropriate behaviour, including conduct of a sexual, coercive, or otherwise unsafe nature, toward any person connected with the Program; or (e) otherwise engages in conduct that Maddison Everist, Bloomin Within reasonably considers incompatible with the ethical standards of the profession or likely to bring the Program, its Students, or Maddison Everist, Bloomin Within into disrepute. Where Maddison Everist, Bloomin Within becomes aware of conduct of this kind after a Certification has been issued, Maddison Everist, Bloomin Within may revoke that Certification and remove the graduate from any associated directory or referral network, in accordance with Clause 18.3. A decision under this Clause 8.5 is at Maddison Everist, Bloomin Within's sole discretion, will where practicable be preceded by an opportunity for the Student to respond, and does not entitle the Student to a refund of Fees paid.
- Attendance and Participation
9.1 While Maddison Everist, Bloomin Within understands that life happens and not every live session can always be attended in real time, a minimum attendance/timely-viewing threshold applies for Certification eligibility, as set out in Clause 8.1(a). Recordings are made available for missed live sessions.
9.2 Students are expected to engage in good faith with the self-paced learning, practicum, and community components of the Program, in a manner consistent with the personal responsibility and integrity the Program asks of its Students and future practitioners.
- Deferrals and Extensions
10.1 A Student who is unable to complete the Program within the standard six-month period due to genuine personal circumstances may apply in writing for a deferral or extension of time to complete outstanding requirements.
10.2 Deferrals are granted at Maddison Everist, Bloomin Within's discretion and may be subject to an administration fee to cover the cost of extended access to Materials and support.
10.3 A Student granted a deferral remains bound by these Terms, including their obligation to complete any outstanding Payment Plan instalments in accordance with Clause 5.
- Practicum, Peer Practice and Client Work
11.1 As part of the Program, Students will practise hypnotic techniques with fellow Students (peer practice) and, where applicable, with practice clients, as described on the Program sales page.
11.2 Students must obtain informed consent from any practice partner or practice client before conducting a hypnotic session with them, including disclosure that the Student is in training and not yet certified.
11.3 Students must maintain the confidentiality of anything shared by a practice partner or practice client during a session, in accordance with Clause 15, and must not record a session without the other person's express consent. Where a session is recorded for the purposes of assessment under Clause 8.1(d), that recording may also be used by Maddison Everist, Bloomin Within for educational and content purposes in accordance with Clause 16.
11.4 Students practising with clients outside the Program cohort during their Practicum do so at their own discretion and risk, and are responsible for ensuring they hold any insurance, disclosures, or consents appropriate to that practice.
11.5 Maddison Everist, Bloomin Within recommends, but does not mandate, that Students obtain student or provisional practitioner insurance during their Practicum period. It is the Student's responsibility to make their own enquiries in this regard.
11.6 Peer practice and practicum sessions are for the purpose of developing hypnotic facilitation skills. They are not a forum for disclosing or processing significant personal trauma; see Clause 12.5.
- Health, Safety and Informed Consent
12.1 Hypnosis and related practices taught in the Program may involve altered states of relaxed awareness, guided visualisation, and emotional processing. While generally considered safe for the general population within a non-clinical context, hypnosis is not suitable for everyone.
12.2 By enrolling, you confirm that you do not have a diagnosed psychiatric condition, epilepsy, or other medical condition for which hypnosis is contraindicated, without having first sought guidance from a qualified medical or mental health professional and disclosed this to Maddison Everist, Bloomin Within prior to participating in any practical exercise.
12.3 Participation in any practical exercise, demonstration, or hypnotic induction during the Program (whether as practitioner or practice subject) is voluntary. You may decline to participate in any specific exercise at any time without penalty to your standing in the Program, though this may affect your ability to meet certain Practicum hour requirements within the standard timeframe.
12.4 If, during the Program, you experience a strong emotional or psychological response that requires support beyond the scope of the Program, Maddison Everist, Bloomin Within will refer you to appropriate external support and encourages you to seek that support promptly.
12.5 Nature of the Program as Personal Development, Not Therapy. The Program includes elements of personal development, self-reflection, and experiential practice as part of learning hypnotic facilitation. This is not group therapy, individual counselling, or a substitute for professional mental health support. Practice sessions, peer work, demonstrations, and community platforms must not be used as a forum for disclosing or processing significant personal trauma. Where a Student wishes to share a personal example or experience for learning purposes, this should be shared briefly and only to the extent relevant to the skill being practised, rather than as an in-depth account of a traumatic event. Where a Student wishes to work through significant personal trauma or psychological difficulty, Maddison Everist, Bloomin Within encourages them to seek support from a qualified mental health professional, and can provide referral information on request. Neither Maddison Everist, Bloomin Within nor its teaching staff act as a Student's personal therapist or counsellor at any point during the Program.
12.6 Suitability, Safety and Right to Terminate Enrolment
Maddison Everist, Bloomin Within reserves the right to assess a Student’s suitability to participate in the Program where concerns arise regarding the Student’s ability to safely and appropriately engage with the training, practical exercises, peer practice, or other Program requirements.
Where Maddison Everist, Bloomin Within reasonably determines that continued participation may not be appropriate due to a Student’s mental health, psychological wellbeing, medical circumstances, behaviour, or any other factor affecting the safety, integrity or effectiveness of the Program, Maddison Everist, Bloomin Within may suspend or terminate the Student’s enrolment.
Where termination occurs under this clause due to suitability, safety or wellbeing concerns, any refund or credit offered will be determined at the sole discretion of Maddison Everist, Bloomin Within, taking into account factors including the timing of termination, access to Program Materials, participation completed, resources allocated, and any costs incurred.
A Student acknowledges that removal from the Program under this clause is not a disciplinary action, but a measure taken to protect the Student, other participants, practice clients, and the integrity of the Program.
- Student Code of Conduct
13.1 Students agree to engage with fellow Students, practitioners, teaching staff and any practice clients with respect, honesty and professionalism, both during live sessions and the Intensive and within any Program community platform.
13.2 Maddison Everist, Bloomin Within maintains a zero-tolerance approach to harassment, discrimination, bullying, or abusive conduct. Students must not attend or participate in any live session, the Intensive, practicum, or any other Program activity while intoxicated or otherwise impaired by alcohol or drugs, and are expected to uphold the ethical standards of the hypnotherapy profession at all times while enrolled in the Program.
13.3 Breach of this Code of Conduct including engaging in harassment, discrimination, or inappropriate behaviour, attending any Program activity while intoxicated, or otherwise breaching professional or ethical standards may result in a warning, suspension, or termination of enrolment in accordance with Clause 20, and may result in Maddison Everist, Bloomin Within withholding, declining to issue, or revoking Certification in accordance with Clause 8.5, at Maddison Everist, Bloomin Within's discretion, without refund.
- Intellectual Property
14.1 All Materials, including curriculum content, recordings, scripts, frameworks (including the Mind Body Bloom framework), workbooks and branding, are the intellectual property of Maddison Everist, Bloomin Within (or its licensors) and are protected by copyright and other applicable laws.
14.2 Your enrolment grants you a personal, non-transferable, non-exclusive licence to access and use the Materials for your own learning and professional practice. You may not reproduce, resell, distribute, publicly share, create content or use the Materials to create a competing course or product, without Maddison Everist, Bloomin Within's prior written consent.
14.3 Any scripts, session recordings, or other materials you create as part of your coursework may be used by you in your own professional practice following Certification. Maddison Everist, Bloomin Within may request your permission to use de-identified excerpts of your coursework for teaching or marketing purposes, which you may decline.
- Confidentiality and Privacy
15.1 Maddison Everist, Bloomin Within will handle your personal information in accordance with its Privacy Policy https://maddison-everist.mykajabi.com/privacy-policy and the Australian Privacy Principles.
15.2 Students must keep confidential any personal information disclosed by fellow Students, practice partners, or practice clients during the course of the Program, and must comply with Clause 11.3.
15.3 Community platforms (e.g., Kajabi, Zoom and any other relevant platforms) used as part of the Program are private spaces for enrolled Students. Content shared within these spaces must not be screenshotted, shared externally, or published without the consent of the person who shared it.
- Photography, Recording and Educational/Content Use
16.1 Live training sessions, the Intensive, and other Program activities may be photographed or recorded by Maddison Everist, Bloomin Within for teaching, quality assurance, assessment, and educational purposes, including uploading recordings or excerpts to Maddison Everist, Bloomin Within's learning platform, community platform, or other channels for use by current and future Students. By attending, you consent to being incidentally captured in such photography or recordings and to their use for these educational and content purposes, unless you notify Maddison Everist, Bloomin Within in writing in advance that you do not consent.
16.2 Where Maddison Everist, Bloomin Within wishes to use photography, recordings, or excerpts featuring you for external marketing or promotional purposes (as opposed to internal teaching, assessment, or Student-facing educational content), Maddison Everist, Bloomin Within will seek your separate consent, which you may decline.
16.3 Maddison Everist, Bloomin Within may invite you to provide a testimonial regarding your experience of the Program following completion. Provision of a testimonial is voluntary, and you may request its removal from use at any time by contacting Maddison Everist, Bloomin Within.
- Limitation of Liability
17.1 To the maximum extent permitted by law, Maddison Everist, Bloomin Within's total liability to you arising out of or in connection with the Program and these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the total Fees paid by you for the Program.
17.2 Maddison Everist, Bloomin Within is not liable for any indirect, consequential, or special loss, including loss of profits, loss of business opportunity, or loss of anticipated income arising from your enrolment in or completion of the Program.
17.3 Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.
17.4 You agree to indemnify and hold Maddison Everist, Bloomin Within harmless against any claim, loss, or liability arising from your breach of these Terms, your conduct toward a practice partner or practice client, or your practice of hypnotherapy outside the scope described in Clause 3, whether during or after the Program.
- Scope of Practice Post-Certification
18.1 Graduates must continue to operate within the non-clinical scope described in Clause 3 following Certification, and must refer clients to appropriately qualified professionals where a matter falls outside that scope.
18.2 Maddison Everist, Bloomin Within is not responsible for a graduate's conduct, advice, or practice following Certification, and holds no liability for claims arising from a graduate's professional practice.
18.3 Maddison Everist, Bloomin Within reserves the right to revoke a Certification and remove a graduate from any associated directory or referral network in the event of serious misconduct, breach of scope of practice, or conduct that brings the Program or profession into disrepute.
- Force Majeure
19.1 Maddison Everist, Bloomin Within is not liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disaster, illness, government restrictions, venue unavailability, or technology failure. In such circumstances, Maddison Everist, Bloomin Within will make reasonable efforts to reschedule affected sessions or the Intensive, or to provide an alternative format.
- Termination
20.1 Maddison Everist, Bloomin Within may suspend or terminate a Student's enrolment, without refund, where the Student: (a) fails to make payment in accordance with Clause 5; (b) breaches the Code of Conduct (Clause 13); (c) engages in conduct that Maddison Everist, Bloomin Within reasonably considers to bring the Program, its Students, or Maddison Everist, Bloomin Within into disrepute; or (d) provides false or misleading information at enrolment.
20.2 A Student may withdraw from the Program at any time by notifying Maddison Everist, Bloomin Within in writing. Refunds (if any) upon withdrawal are governed by Clause 7.
- Changes to the Program or These Terms
21.1 Maddison Everist, Bloomin Within may make reasonable changes to the Program's content, format, schedule, or facilitators between the time of your enrolment and Program commencement, or during the Program, provided the overall quality and substance of the Program is not materially diminished.
21.2 Maddison Everist, Bloomin Within may update these Terms from time to time. Material changes will be notified to enrolled Students by email. Continued participation in the Program following notice of a change constitutes acceptance of the updated Terms.
- Dispute Resolution
22.1 If a dispute arises under this Agreement, both parties agree to first attempt to resolve the matter through good-faith discussion directly with Maddison Everist, Bloomin Within by contacting hello@bloominwithin.com.au.
22.2 If the dispute cannot be resolved within [30] days, either party may refer the matter to mediation with [a mutually agreed mediator / a recognised mediation body], before pursuing formal legal proceedings.
- Governing Law and Jurisdiction
23.1 This Agreement is governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of the courts of that State/Territory.
- Entire Agreement
24.1 This Agreement, together with the Program sales page, enrolment form, and Privacy Policy, constitutes the entire agreement between you and Maddison Everist, Bloomin Within regarding the Program and supersedes any prior representations, whether written or oral.
